Privacy policy

What we collect, why we hold it, how long we keep it, and what you can ask us to do about it.

Who we are

Tempeo Construction Solutions Limited, trading as Tempeo Trades & Labour, is the data controller for the personal data described in this policy. We are registered in England and Wales under company number 17209283, at 22/23 Moulton Park Business Centre, Redhouse Road, Moulton Park Business Park, Northampton, NN3 6AQ.

We are an employment business and employment agency supplying temporary and permanent workers to the construction industry. If you have a question about this policy, or want to exercise any of the rights below, write to recruitment@tempeo.co.uk or ring 01604 969 304.

Whose data we hold

Clients and prospective clients

Names, job titles, work email addresses, phone numbers, company details, and the content of enquiries and orders you send us.

Candidates and workers

Name, contact details, work history, trade and qualifications, the cards and tickets you hold, documents proving your right to work, National Insurance number, Unique Taxpayer Reference where you are paid through CIS, bank details for payment, and records of the assignments you work.

Where a role requires it, we may also hold information about health or criminal convictions. That is special category or criminal offence data, we only collect it where a client or the law requires it for a specific assignment, and we hold it under the substantial public interest and employment law conditions in the UK GDPR and the Data Protection Act 2018.

How we collect it

  • Directly from you, by phone, email, our enquiry forms, or our candidate portal at https://tempeo.prime.primepro.net/candidate-login
  • From job boards and professional networks where you have made your details available for work
  • From referees you have named
  • From card and qualification schemes, when we verify a card you have told us you hold
  • From clients, when they report on an assignment you have worked

Why we use it, and our lawful basis

  • To supply workers and fill vacancies. Performance of a contract with you, or steps taken at your request before entering one.
  • To find you work and tell you about suitable assignments. Our legitimate interests in operating a recruitment business, balanced against your interest in not being contacted about work you do not want. You can tell us to stop at any time.
  • To pay you and account for tax. Legal obligation, and performance of a contract.
  • To check your right to work in the UK. Legal obligation.
  • To keep the records an employment business must keep. Legal obligation under the Conduct of Employment Agencies and Employment Businesses Regulations 2003.
  • To respond to enquiries from clients. Our legitimate interests in answering people who contact us about our services.

Who we share it with

We share only what is needed, with:

  • Clients, when we put you forward for an assignment or a role
  • Card and qualification schemes, to verify a card is valid and in date
  • Referees you have named
  • HMRC, as the law requires, including CIS returns and PAYE reporting
  • Our software suppliers, including the recruitment system that holds candidate records and the hosting provider that runs this website

We do not sell personal data, and we do not share it for anyone else's marketing.

Where it is held

Our systems and their suppliers are based in the UK, the European Economic Area, or countries with a UK adequacy decision. Where data does move outside those, we put appropriate safeguards in place, normally the UK International Data Transfer Addendum to the standard contractual clauses.

How long we keep it

We keep personal data only as long as we need it, then delete it. In practice that means:

  • Right to work documents, for two years after an assignment ends, as the Home Office requires
  • Payroll and tax records, for the periods HMRC requires
  • Records an employment business must keep, for at least one year, as the Conduct Regulations require
  • Candidate records where you are not working for us, for a defined period after our last contact, after which we either ask whether you want to stay on our books or delete the record
  • Client enquiry records, for as long as we have a working relationship, and a reasonable period afterwards

Your rights

Under UK data protection law you can ask us to:

  • Give you a copy of the personal data we hold about you
  • Correct anything that is wrong
  • Delete data we no longer have a good reason to keep
  • Restrict how we use it, or object to us using it
  • Transfer it to another organisation in a portable format

Where we rely on consent, you can withdraw it at any time. Ask us using the details above and we will respond within one month.

If you are not happy with how we have handled your data, tell us first and we will try to put it right. You also have the right to complain to the Information Commissioner's Office at ico.org.uk, or on 0303 123 1113.
